Time Warner Cable and Viacom Settle Lawsuit Over iPad Television Streaming

Time Warner Cable and Viacom have settled their legal entanglements regarding Time Warner’s streaming of Viacom video content on its iPad app , according to the New York Times . The breakthrough comes as a result of a settlement between Time Warner Cable and Viacom, which owns cable channels like Comedy Central, Nickelodeon, MTV and others. For months there had been a heated dispute over whether the cable company should have access to Viacom programs through its TWCable TV app. On Wednesday, Viacom said that the companies had agreed “to resolve their pending litigations” and that “all of Viacom’s programming will now be available to Time Warner Cable subscribers for in-home viewing via Internet protocol-enabled devices such as iPads.” The companies have been fighting over streaming rights for more than a year. Time Warner argued that its existing agreements give it the right to provide video streams on any screen, rather than just the television. Viacom said the app was “unlicensed distribution of Viacom’s programming.” Viacom still has a pending lawsuit with Cablevision over its Optimum live TV app. Viacom’s programming will roll out on the Time Warner Cable app over the next few weeks. Psystar finally rebuffed by Supreme Court

Apple Reportedly Offers Proview $16 Million for iPad Trademark [iOS Blog]

Following a claim earlier this week that Apple had made its first settlement offer to Proview in the ongoing dispute over the “iPad” trademark in China, The Next Web now points to a report from Sina.com [ Google translation ] claiming that Apple’s offer amounted to 100 million yuan, equivalent to $16 million. That marks a substantial increase over the $55,000 purchase price in the original deal between Proview’s Taiwanese arm and a dummy corporation set by Apple to acquire the trademark in a number of countries. Proview later claimed that the Chinese rights to the trademark were owned by its Chinese subsidiary and that the Taiwanese arm consequently could not have sold them to Apple. Proview has been seeking as much as $2 billion in its lawsuits against Apple over the trademark, but today’s report notes that Proview has gone bankrupt with $400 million owed to its creditors, speculating that that amount would be the minimum it the company would accept from Apple. It seems extremely unlikely that Apple would increase its offer to that level, and so it remains to be seen how the talks and court case will play out. Continue reading

Apple Wants Trial Started in Samsung Case to Stop "Continuing Infringement" [iOS Blog]

Apple and Samsung have been suing each other for years, and Apple wants things to move along a little faster in the main U.S. case in California — Apple wants to start the jury trial on July 30th as scheduled. Samsung believes the case is too large to go to trial, and wants to delay proceedings while the companies hash things out further. Both Samsung and Apple have agreed to narrow their claims and the scope of the case in order to move things along, but the companies are still very far apart on numerous issues. Going further, Apple believes Samsung has been intentionally dragging its feet to avoid a judgement that may impact its very successful mobile products business. From an Apple pleading, via FOSS Patents : While the parties have been readying the case for trial Samsung has vaulted into first place in worldwide sales of smartphones, with massive sales of its copycat products . Samsung’s infringement of Apple’s intellectual property has already resulted in damages that reach billions of dollars. It is critical to Apple to start trial on July 30, to put an end to Samsung’s continuing infringement. The more than 50 cases between Apple and Samsung cover a number of technical patents, design patents, trade dress and more — across 10 countries. Whether or not a jury trial starts this summer, the crush of mobile lawsuits likely won’t be ending any time soon, regardless of what Apple CEO Tim Cook would prefer . The best chance for ending the legal fight in the short term is the court-ordered mediation that Apple and Samsung’s CEO’s have agreed to participate in. Continue reading

App Developer Offers Handy High-Res PSD File of iPad GUI Elements for Mockups [iOS Blog]

App developers Geoff Teehan and his team created this high resolution Photoshop file to help them when mocking up ideas for app designs. The file includes full-resolution elements of buttons, keyboards, and all the other user interface elements that are available to iOS developers. Instead of keeping the file for themselves — which would be understandable — Teehan decided to share it with the larger development community. The team has previously other versions of the file, as well, including one for the iPhone 4S . In 2008 we released our first iOS PSD . We continue to do it, not only because we find useful, but because we think a lot of other designers do too. In fact, over the past four years they’ve been downloaded millions of times. It’s become our little thank you to an industry that has given us so much. We’re really proud to be releasing our latest version today. It’s based on iOS 5.1 and includes hundreds of retina assets available natively on the platform. Legal Experts Suggest Justice Department Unlikely to Win Antitrust Suit Against Apple

In the wake of yesterday’s announcement that the U.S. Department of Justice has filed an antitrust lawsuit against Apple and a number of book publishers over alleged price fixing, CNET notes that the government may have a hard time winning its case against Apple. The publishers may, however, find themselves on the losing end of the case should they be unwilling to settle. “It’s a harder case against Apple than the publishers,” says Geoffrey Manne, who teaches antitrust law at the Lewis and Clark Law School in Oregon and runs the International Center for Law and Economics. One reason lies in the Justice Department’s 36-page complaint, which recounts how publishers met over breakfast in a London hotel and dinners at Manhattan’s posh Picholine restaurant, which boasts a “Best of Award of Excellence” from Wine Spectator magazine. The key point is that Apple wasn’t present. But even the case against the publishers is not a sure thing for the Department of Justice. Some experts suggest that even amid claims that the publishers met to discuss a shift to an agency model being championed by Apple, the publishers may not be found guilty of antitrust violations. Specifically, the Supreme Court has ruled in the past that pricing arrangements among competitors are not automatically considered to be violations of antitrust law, and that the setting of minimum retail pricing by manufacturers is a permitted policy. Several of the publishers involved in the lawsuit have already settled, but Macmillan and Penguin are holding out along with Apple to fight the case. Almost immediately following the filing of the Department of Justice’s lawsuit, a number of states filed their own claims against the companies, citing customer overcharges of over $100 million since the move to an agency model of pricing. Regulators in other countries are also reportedly looking at whether they wish to take action on the matter. Continue reading

One of the first print ads for Siri has been spotted in the latest issue of Rolling Stone magazine, reports Twitter user Philip Bernstein. Apple’s Patent War Against Android May Lead to Settlements Under Tim Cook’s Influence

Bloomberg Businessweek publishes a cover story on the ongoing patent war between Apple and Android, outlining the history of the disputes between Apple and Android manufacturers such as HTC, Samsung and Motorola. The report notes that Apple has actually experienced only limited success in its legal efforts, suggesting that Steve Jobs’ vow to wage “thermonuclear war” against Android may be backfiring somewhat with Apple’s soaring legal costs and retaliatory actions from its targets subjecting the company to risk while the benefits remain meager. Photograph by Jochen Seigle/Polaris Corroborating claims from earlier this month regarding Apple’s willingness to settle with the Android device manufacturers it has filed suit against, Bloomberg Businessweek reports that Apple and Samsung have “communicated lately” about settlement possibilities. The report suggests that settlement has become a more feasible option now that Apple is led by Tim Cook. People familiar with the situation, however, note that top-level executives at both Apple and Samsung have communicated lately about potential settlement options. Apple CEO Tim Cook does not seem to share his predecessor’s passion about laying all foes to waste. Cook appears to view litigation as a necessary evil, not a vehicle of cosmic revenge. Stanford University law professor Mark Lemley notes that the patent war has cost Apple and its opponents over $400 million over the past few years, and it is unclear just what benefits they have received for that massive sum of money. Lemley predicts that there will eventually be a major cross-licensing deal to bring the majority of the legal disputes to an end, but in the meantime the war continues to escalate as all sides continue to file new suits.
