Tim Cook and Samsung CEO Choi Gee-sung Meeting Today to Discuss Patent Issues

Following last month’s announcement that Apple and Samsung had agreed to high-level talks involving the two companies’ CEOs in an attempt to resolve ongoing patent litigation, Reuters provides a preview of the session set to begin today in San Francisco. The talks, which will be mediated by a federal judge, are scheduled to take place over the next two days. Commenting before his departure to the United States for the talks, Samsung mobile division chief JK Shin noted that while significant differences between Apple and Samsung still exist, a number of “negotiation options” remain on the table. “There is still a big gap in the patent war with Apple,” JK Shin said, before departing for the United States for the mediation talks. “But we still have several negotiation options.” Court documents show the two companies have had at least one mediation session, although it is not clear if Cook and Choi were involved. Legal experts are not optimistic that the two companies will reach a settlement, but with courts increasingly pushing companies to seek alternative dispute resolution processes in hopes of staving off drawn-out court battles, Apple and Samsung have agreed to participate in the talks. Samsung is just one of Apple’s main targets in its patent battles with Android-based hardware manufacturers. In another case, Apple succeeded in slowing U.S. imports of several HTC smartphones earlier this month, forcing the company to delay the launch of the Evo 4G LTE on Sprint although HTC has indicated that some shipments of some models are being released by U.S. Customs. But while Apple’s disputes with several Android device manufacturers center on functionality of the devices, the company’s dispute with Samsung extends further to claims that Samsung has “chosen to slavishly copy” the design of Apple’s products with its own line of Galaxy smartphones and tablets. HTC Delays Evo 4G LTE Launch as U.S. Customs Investigates Shipments for Breach of Apple Patent

Last December, Apple won a U.S. International Trade Commission case against HTC, with the agency ruling that several of HTC’s handsets infringed upon a pair of Apple-held patents. The agency’s ruling included a ban on the import of infringing devices beginning in April, although HTC quickly responded to say that it had already designed a workaround for the issue in question. But as reported by The Verge late yesterday, U.S. Customs officials have delayed shipments of HTC’s new One X and Evo 4G LTE handsets into the United States as it investigates whether those handsets also infringe upon Apple’s patents. We’ve learned today that the One X and Evo 4G LTE are indefinitely delayed at Customs as the agency investigates patent issues with Apple, and sources have further confirmed that some shipments are indeed being held back. The One X is also currently out of stock at AT&T’s online store and at most AT&T retail stores we’ve called — and few had any information on when more units would arrive. HTC issued a follow-up statement confirming the customs hold and indicating that it is working to secure the release of the shipments. The US availability of the HTC One X and HTC EVO 4G LTE has been delayed due to a standard U.S. Customs review of shipments that is required after an ITC exclusion order. We believe we are in compliance with the ruling and HTC is working closely with Customs to secure approval. The HTC One X and HTC Evo 4G LTE have been received enthusiastically by customers and we appreciate their patience as we work to get these products into their hands as soon as possible. Dow Jones Newswires provides more information today, noting that HTC will need to delay the launch of the Evo 4G LTE, which had been scheduled to debut on Sprint this Friday, May 18. In addition, AT&T is experiencing shortages of the One X due to the customs hold, although some units were able to enter the country before the import ban went into effect on April 19. Apple vs. Motorola, HTC suit combined, moved to 2014

Apple has won a scheduling victory over Motorola and HTC in the latest round of the giants’ patent battles in Florida today. An exasperated judge consolidated the disparate trials, which consist of of patent infringement claims by Apple against both companies and counter-claims from them, in part because of a lack of cooperation between the parties. Apple modifies nano-SIM design to address Nokia concerns

Apple has modified a proposed nano-SIM design to accommodate objections by Nokia, says The Verge. SIM card maker Giesecke & Devrient has been showing off the design at the CTIA trade show in New Orleans. The European Telecommunications Standards Institute is soon set to vote for one of several card designs proposed by cellphone makers; a vote was, in fact, originally scheduled to take place in March, but the dispute between Apple and Nokia led to a postponement…. Apple Wants Trial Started in Samsung Case to Stop "Continuing Infringement" [iOS Blog]

Apple and Samsung have been suing each other for years, and Apple wants things to move along a little faster in the main U.S. case in California — Apple wants to start the jury trial on July 30th as scheduled. Samsung believes the case is too large to go to trial, and wants to delay proceedings while the companies hash things out further. Both Samsung and Apple have agreed to narrow their claims and the scope of the case in order to move things along, but the companies are still very far apart on numerous issues. Going further, Apple believes Samsung has been intentionally dragging its feet to avoid a judgement that may impact its very successful mobile products business. From an Apple pleading, via FOSS Patents : While the parties have been readying the case for trial Samsung has vaulted into first place in worldwide sales of smartphones, with massive sales of its copycat products . Samsung’s infringement of Apple’s intellectual property has already resulted in damages that reach billions of dollars. It is critical to Apple to start trial on July 30, to put an end to Samsung’s continuing infringement. The more than 50 cases between Apple and Samsung cover a number of technical patents, design patents, trade dress and more — across 10 countries. Whether or not a jury trial starts this summer, the crush of mobile lawsuits likely won’t be ending any time soon, regardless of what Apple CEO Tim Cook would prefer . The best chance for ending the legal fight in the short term is the court-ordered mediation that Apple and Samsung’s CEO’s have agreed to participate in. Continue reading

Apple, Samsung narrow patent claims in California lawsuits

Late on Monday, Apple and Samsung both agreed to drop several patent infringement claims in the companies’ California legal battle, according to FOSS Patents. Apple is said to have started the process, filing to drop roughly half of its claims. Five hours later Samsung followed suit, offering drop five out of 12 patents, but still arguing that Apple’s case is too large to go to trial in the summer. Apple wants Samsung logos, Isaacson quotes out of court

Both Apple and Samsung have issued a series of demands for their potential court trial in the Northern District of California, according to FOSS Patents. Apple’s filing makes several requests, for instance requiring Samsung displays in the courtroom to have their logos covered up. The company is also demanding a block on any quotes from Apple co-founder Steve Jobs found in the biography by Walter Isaacson. Jobs infamously went on a rant about Android when interviewed, saying he was ready to “go to thermonuclear war” to “destroy” the platform. Google’s Andy Rubin: Java APIs were copyrighted

Google’s mobile VP Andy Rubin gave testimony on Monday in Oracle’s lawsuit that Java was likely copyrighted, raising the possibility Google owed royalties for Android. He wouldn’t link the copyrighting to Sun, but he agreed with an Oracle attorney that a 2006 e-mail had said the java.lang app programming language (APIs) “were copyrighted,” according to CNET’s account of the conversation. Microsoft and Facebook strike deal over AOL patents
