Apple Adds Another 150,000 SF to Sunnyvale Real Estate Footprint [Mac Blog]
Last month, we noted that Apple had signed a pair of leases for over 300,000 square feet of space in Sunnyvale, the company’s first venture into the city next door to its home in Cupertino, California. The leases were said to be part of a larger effort in which Apple was looking to secure 700,000-800,000 square feet of space in Sunnyvale as it continues to grow and to tide it over until its massive new headquarters campus opens several years from now. According to a press release (PDF) from the City of Sunnyvale, another piece of that plan has fallen into place with Apple’s commitment to lease a new 156,000 square foot building in downtown Sunnyvale. Apple is said to be planning to move 400 employees to the building, which sits directly adjacent to a similar building where Nokia just last year consolidated the majority of its Bay Area operations. Sunnyvale City Manager Gary Luebbers has announced that Apple will join the ranks of high-tech businesses located in downtown Sunnyvale. Apple will occupy the new 156,000 square-foot Town Center Office building at Mathilda and McKinley avenues. “This is an important step forward,” said Luebbers. Our entire community will benefit as we see yet another large gain in the Town Center redevelopment project.” Apple plans to occupy the new building in the third quarter of this year. Apple’s planned “spaceship campus” in Cupertino is set to offer 2.8 million square feet of space, but the structure will not be complete until 2015. In the meantime, Apple has continued to snap up real estate leases wherever it can in Cupertino and the surrounding area to accommodate its rapidly-growing workforce. Apple currently employs roughly 25,000 full-time non-retail employees, the vast majority of which operate out of or near the company’s Cupertino headquarters. Continue reading

Apple Pushes for Clarification on Licensing of FRAND Patents
Dow Jones Newswires reports that Apple filed a letter with the European Telecommunications Standards Institute (ETSI) last November pushing for clarification on how standards-essential patents are intended to be licensed. These standards-essential patents are currently required to be licensed under fair, reasonable and non-discriminatory (FRAND) terms in order to promote competition in the marketplace, but Apple claims that there is too much confusion in the industry about how such licensing should be handled. Apple said in its letter–which was dated Nov. 11, but not previously disclosed–that the lack of clarity on what is fair, reasonable and nondiscriminatory has led many companies to ask unusually high rates and sue one another claiming they infringed on one another’s patents. “It is apparent that our industry suffers from a lack of consistent adherence to Frand principles in the cellular standards arena,” wrote Bruce Watrous, Apple’s intellectual property head. Apple has requested that the ETSI set “appropriate” royalty rates for FRAND patents in the wireless industry in order to help companies compete on a relatively even field with a clearer understanding of the costs involved in competing in the market. The company has also requested that FRAND patents not be used as the basis for requests for injunctions that would remove products from the market, given that those patents are intended to be licensed and that any negotiation roadblocks are related to the details of that licensing. Apple certainly has a vested interest in seeing simplified FRAND patent licensing terms, given that it was a relatively late entrant into the mobile phone industry where the vast majority of patents covering the basic technologies are owned by other companies. While Apple has primarily relied on claims of design infringement and specific user interface functionalities in its efforts to block smartphone sales by its competitors, it has been the target of lawsuits based on more fundamental inventions. In one example, Apple briefly pulled all of its 3G-capable iOS devices with the exception of the iPhone 4S from its German online store last week in the wake of a victory by Motorola Mobility in the ongoing patent dispute between the two companies. That injunction was quickly suspended pending Apple’s appeal of the ruling, with Apple arguing that the patents in question are subject to FRAND licensing requirements that are not being met by Motorola. Apple claims that Motorola has “demanded” a royalty rate of 2.5% to license the patent, a figure that would have resulted in Motorola receiving roughly $1 billion from Apple in 2011. Continue reading

Apple to Give Employees $500 Off Macs and $250 Off iPads
According to 9to5Mac , during today’s town hall meeting , Apple CEO Tim Cook announced to employees that they would get $500 off Macs and $250 iPads. The new discount program starts in June 2012, and can only be used once every 3 years. Employees also need to have been working at Apple for at least 90 days. The discount is reportedly for both corporate and retail employees. The discount is said to exclude the Mac mini. Apple employees presently are allowed a one-a-year 25% discount on Apple systems. One report even claims that this discount will remain in place alongside the new discounts. In 2007, shortly after the original iPhone’s launch, Apple had announced a similar perk for employees. At that time, Steve Jobs announced that all full time and part time Apple employees would receive an 8GB iPhone. Continue reading

Apple Researching Motion-Sensing Virtual 3D User Interface for iOS Devices
Patently Apple reports on a newly-published patent application from Apple describing the use of motion sensors to create a virtual three-dimensional interface for iOS devices. Utilizing concepts similar those found in a number of existing augmented reality apps, the general device interface could appear as a virtual room that could be navigated by changing the orientation of the device. The invention covers a 3D display environment for mobile device that uses orientation data from one or more onboard sensors to automatically determine and display a perspective projection of the 3D display environment based on the orientation data without the user physically interacting with (e.g., touching) the display. Apple describes the use of gyroscope sensors that would allow the “camera view” of the virtual room to rotate as the user rotates their device. Apple also mentions that sensors could be used to detect gestures above the surface of the device’s display in order to allow for natural 3D manipulation of the user interface environment. Finally, Apple’s patent application discusses a “snap to” feature that would allow users to easily transition between various “walls” within the virtual room. In another patent application filed in mid-2007, Apple discussed a similar notion of multi-dimensional desktops in Mac OS X, showing a virtual room with various groups of icons on the different walls of the room. Apple followed that up with another patent application looking at hyper-reality displays that would allow for orientation- and motion-based manipulation of 3D objects. Continue reading

Kodak Files New Patent Infringement Lawsuits Against Apple and HTC [iOS Blog]
With Kodak on the brink of filing for bankruptcy as it pursues an auction of its patent portfolio in order to remain solvent, the company today announced that it has filed two new lawsuits alleging patent infringement by Apple and HTC. A complaint filed with the U.S. International Trade Commission (ITC) specifically claims that certain of Apple’s iPhones, iPads, and iPods, and certain of HTC’s smartphones and tablets infringe Kodak patents that relate to technology for transmitting images. Kodak also alleges that certain of HTC’s smartphones infringe a patent that covers technology related to a method for previewing images which is already the subject of pending actions against Apple. Separately, Kodak filed suits today against Apple and HTC in U.S. District Court for the Western District of New York alleging the same infringement. “As we have stated before, Kodak is the leader in digital imaging innovation and we have invested hundreds of millions of dollars creating our pioneering patent portfolio,” said Laura G. Quatela, President and Chief Operating Officer, Eastman Kodak Company. “We’ve had numerous discussions with both companies in an attempt to resolve this issue, and we have not been able to reach a satisfactory agreement.” The four patents being asserted against Apple include: – U.S. Patent No. 7,210,161 – “Automatically Transmitting Images from an Electronic Camera to a Service Provider Using a Network Configuration File” – U.S. Patent No. 7,742,084 – “Network Configuration File for Automatically Transmitting Images from an Electronic Still Camera” – U.S. Patent No. 7,453,605 – “Capturing Digital Images to be Transferred to an E-Mail Address” – U.S. Patent No. 7,936,391 – “Digital Camera with Communications Interface for Selectively Transmitting Images over a Cellular Phone Network and a Wireless LAN Network to a Destination” A fifth patent is being asserted only against HTC. Kodak first filed a patent infringement suit against Apple in January 2010 , also targeting Research in Motion in the same effort. Apple filed a countersuit a few months later in an effort to bolster its position against Kodak. With the new lawsuits coming just as Kodak is attempting to stave off bankruptcy, the company appears to be attempting to demonstrate strength in its patent portfolio as it hopes to attract higher bids for its intellectual property. Even if the company is unable to avoid bankruptcy, its patent portfolio is likely to be one of the key assets to be sold off in a court-ordered auction following the bankruptcy filing.
